How to Buy Property in Panama as a Foreigner: A Step-by-Step Guide

One of the first questions we hear is a reassuring one to answer: can foreigners actually buy property in Panama? Yes — and it’s more straightforward than most people expect. Foreigners have the same ownership rights as Panamanian citizens when it comes to titled property. Here’s the process, step by step.

Step 1 — Find the right property (and confirm how it’s held)

Before you fall in love with a place, confirm whether it is titled or held under Rights of Possession (ROP). Titled property is registered in the Public Registry and offers the strongest ownership. ROP is common on some islands and can be fine, but it works differently and needs extra care.

Step 2 — Make an offer and sign a promise of sale

Once you agree on a price, both sides sign a promise-to-purchase agreement (contrato de promesa de compraventa). This sets the price, terms and timeline, and usually comes with a deposit held in escrow.

Step 3 — Do your due diligence

Your attorney confirms the title is clean — no liens, no unpaid taxes, clear boundaries. For ROP or island properties, this step is especially important. Never skip it, and always use an independent attorney who represents you.

Step 4 — Sign the purchase deed

The final sale is done through a public deed (escritura pública) signed before a notary and then registered in the Public Registry. When the deed is registered in your name, you are the legal owner.

Step 5 — Pay taxes and closing costs

Budget for closing costs on top of the price. As a general guide, total closing costs usually run about 2%–5% of the purchase price. This includes a 2% property transfer tax, notary and Public Registry fees, and legal fees (often around 0.5%–1%). Your attorney will give you an exact breakdown before closing.

A few smart tips

  • Use an independent Panamanian real estate attorney. This is the most important safeguard in the whole process.
  • Keep proof your funds came from abroad. You’ll want this if you later apply for residency.
  • Don’t rush ROP purchases. They can be great value, but only with proper legal guidance.
